Framework 03 · The charitable trust layer

ConsecrationThe public layer

A charitable trust that educates, serves, and carries the outward-facing work. The public face of your private economy.

What This Framework Does

The Work, Plainly Stated

Consecration declares your charitable trust, which you may run as a foundation, a ministry or a church: owned by no one, with a purpose rather than a person as its beneficiary. It holds a treasury, can hold real property apart from its programs, and moves outward-facing activity into an entity built to carry it — which is what protects the two private layers beneath.

Start here if you want a mission-driven public layer, or if service to community is the reason you are building at all.

Delivered Formed, Never a Template

What You Receive

MODULE C1

Charitable Trust Formation & Posture

Your charitable trust, which you may run as a foundation, a ministry or a church, owned by no one, with a purpose as its beneficiary. Formed under the exception that means it never applies to anyone for recognition — and operated to the conduct rules that come with that exception, which is the half most people skip. Three trustee seats, and one person can found it: you serve as Minister while the two independent seats fill, and nothing is paid to you until they do.

MODULE C2

Status Record & Assembly Log

What proves a charitable trust is what it says it is: the record of who gathers, when, and for what. Both opened at formation, because neither one can be created backward.

MODULE C3

Treasury & Unleveraged Holdings

How the charitable trust holds and grows a treasury, the exact conditions under which that income becomes taxable, and the register that keeps every holding on the right side of the line.

MODULE C4

Operations Subsidiary & the Endowment Policy

A taxable subsidiary to carry anything that trades, so the charitable trust itself never does, plus the endowment policy the charitable trust owns.

MODULE C5

Minister’s Kit

The housing allowance, the payroll posture, and the record that has to exist for either of them to hold up.

MODULE C6

Property & the Title-Holding Company

Real property held apart from the programs, in a company built for holding and nothing else, set up for the one reason most structures miss.

MODULE C7

The Dirt Engine

The long window a charitable trust gets on land that other owners do not, how to prove you are financing land rather than buildings, and the dates that window turns on.

MODULE C8

The Earning Side

What a charitable trust can earn without owing tax on it — rents, natural resources, conservation and carbon — and the specific ways each of those turns taxable.

MODULE C9

Selling & the Return Line

When the charitable trust sells, what is excluded and what is not, and the intent record that decides which. Plus the one return that becomes mandatory once unrelated business income reaches the threshold, where the tax is owed and not merely reported.

MODULE C10

Grant Engine

How the structure reaches grant money that requires a determination letter, without the charitable trust ever applying for one. What that costs, and what it buys.

When this framework is in place

  • A declared charitable trust with its Declaration of Charitable Trust, its Trustee Governance Schedule, and the trustee certification banks accept
  • The status record and assembly log open from day one
  • A treasury held so its investment income stays excluded, with the register that proves it
  • A taxable subsidiary carrying anything that trades, and an endowment policy the charitable trust owns
  • Real property held apart from the programs
  • A candid earning map: what is excluded, what is taxable, and the return that is mandatory

Consecration, Answered

What kind of organization is this?

A church organized as a charitable trust, of the kind described in section 508(c)(1)(a) of the Internal Revenue Code. It is excepted from applying for recognition — no application, no determination letter — and it keeps the same conduct rules every exempt organization keeps. One person can found it: you serve as Minister while the two independent trustee seats fill.

Do I need to run a religious organization?

Yes. Consecration forms a church, and a church is a real religious body: a creed in your own words, a form of worship, and people who gather. The church status record and the assembly log are how that is proved, and both open on day one. If your mission is education or service without a religious body, the consultation says so plainly and maps a different form.

Is it true there is nothing to file?

Partly, and the distinction matters. The form is an exception from having to apply for recognition — no application, no determination letter. It is not an exception from the conduct rules that come with exempt status, and it is not an exception from every return: once unrelated business income reaches the threshold, one return is mandatory and the tax is owed. Anyone promising you no filings and no tax is selling you a problem.

Do I need the other two frameworks first?

No. Consecration is complete on its own and operates from day one. Where another framework is present, a single one-page instrument joins them — not a rebuild.

How does Consecration protect the other two frameworks?

It moves outward-facing activity into an entity built to carry it, and gives the architecture a public, mission-driven face. The private layers stop being the ones standing in front.
